Service Terms
These Service Terms apply to concrete pumping and related services provided by Redwood Concrete Pump (“Redwood,” “we,” “us”), California Contractors State License #639478 (classifications C61/D06), to the person or company that requests or accepts our services (“Customer”). They apply together with the written quote, work order or invoice for the job. If a signed agreement or a quote conflicts with these terms, the signed agreement or quote controls.
1. Quotes and estimates
Quotes and estimates are based on the information the Customer provides (location, access, pour type, volume, schedule). If the actual conditions, quantities, schedule or scope differ, the price may change. A quote is not a commitment to perform until the job is accepted and scheduled by us. Pricing elements such as minimum charges, travel, hose or pipeline extensions, washout, and waiting (standby) time are as stated in the quote or work order.
2. Scheduling, delays and cancellations
Dispatch times are estimates and depend on traffic, weather, equipment readiness and prior jobs. The Customer must tell us promptly about any change, delay or cancellation. Late cancellations, reschedules, and delays that keep our equipment and crew waiting (including delays by the concrete supplier, crew, inspections or site readiness) may be charged as stated in the quote or work order.
3. Site access and conditions (Customer responsibilities)
The Customer is responsible for providing and confirming, before our arrival: safe, level and sufficiently firm access and set-up areas for our equipment and its outriggers; clearance from overhead power lines and other overhead hazards, and notice of underground utilities, septic systems, vaults or voids (call 811 before digging); required permits, traffic control and street or neighbor access; a suitable washout area; and forms, reinforcing and a ready placement crew. We are not responsible for damage to driveways, curbs, landscaping, utilities, septic or underground structures, or other site features resulting from the weight or operation of equipment on areas the Customer designated or approved.
4. Concrete supply and quality
We provide pumping services. Unless we have agreed otherwise in writing, we do not supply, mix, test or control the concrete. The Customer and its concrete supplier are responsible for the mix design, slump, additives, timing, finishing, curing and the quality and strength of the concrete placed. We are not responsible for cracking, scaling, discoloration, strength or other performance of concrete, or for defects in formwork, reinforcement or subgrade.
5. Safety
Our operators have final authority over the safe operation of our equipment. We may stop, delay or decline work, without liability, if conditions are unsafe, including unsafe access, ground conditions, overhead hazards, weather, or Customer instructions that would violate safety requirements or law. The Customer will keep unauthorized people clear of the equipment and pipeline.
6. Charges and payment
The Customer agrees to pay all charges shown on the quote, work order and invoice, plus any additional charges for work performed at the Customer’s request or caused by site conditions or delays. Payment is due as stated on the invoice. Invoice questions must be raised in writing promptly and before the due date, and any undisputed portion must be paid when due. Past-due balances may accrue interest at the maximum rate permitted by law, and the Customer will pay reasonable costs of collection, including attorneys’ fees, as permitted by law. You can submit payment or a payment notice at Make a Payment.
7. Lien rights
As permitted by California law, we reserve all rights to preserve and enforce payment, including serving preliminary notices and recording mechanics’ liens and stop payment notices, and to make claims against payment bonds on public works. Providing a preliminary notice is a normal part of the construction payment process and is not an accusation of nonpayment.
8. Public works
For public works projects, Redwood Concrete Pump is registered with the California Department of Industrial Relations (Public Works Contractor Registration #1000010460) and will comply with applicable prevailing wage and certified payroll requirements. Customers needing bid packages, certifications or vendor documentation (including our Women Business Enterprise certification #1600964 and Cal eProcure Bidder/Supplier ID BID0022380) can contact our office.
9. Insurance
We maintain insurance appropriate to our operations. Certificates of insurance are available to Customers on request, and additional-insured endorsements can be arranged when required by contract.
10. Limits of liability
To the fullest extent permitted by law, our total liability for any claim arising from our services is limited to the amount the Customer paid us for the specific service giving rise to the claim, and we are not liable for indirect, incidental, special or consequential damages, including delay, lost profits or the cost to remove and replace concrete. The Customer must report any claimed damage or loss to us promptly, and in any event before the equipment leaves the site where practicable, so it can be documented. The Customer will defend and indemnify us against claims arising from the Customer’s site conditions, instructions, designs, concrete or breach of these terms, except to the extent caused by our sole negligence or willful misconduct.
11. Events beyond our control
We are not liable for delay or failure caused by events beyond our reasonable control, including severe weather, road closures, equipment breakdown, supplier failures, labor disputes, government action, fire or other disasters.
12. Disputes and governing law
The parties will first try to resolve disputes informally and in good faith. These terms are governed by California law, and any lawsuit will be brought in the state or federal courts in Sonoma County, California.
13. California contractor license notice
Contractors are required by law to be licensed and regulated by the Contractors’ State License Board. Any questions concerning a contractor may be referred to the Registrar, Contractors’ State License Board, P.O. Box 26000, Sacramento, CA 95826. Redwood Concrete Pump holds California Contractors State License #639478. You can verify our license at cslb.ca.gov.
